A key legislative development aimed at revoking the President’s authority to grant mining licenses in forest reserves has been introduced to Parliament. The Legislative Instrument (L.I.) 2462 was officially laid before the House on March 20, 2025, following a series of procedural disagreements earlier in the week.
The instrument is designed to strip the President of the power to approve mining activities in forest reserves, a move intended to address illegal small-scale mining activities, commonly known as galamsey.
Earlier this week, the introduction of the L.I. faced challenges. Minority Leader Alexander Afenyo-Markin called for a mandatory pre-laying process, while the Majority Leader Mahama Ayariga argued that the L.I. was a straightforward amendment that had already garnered consensus. After some back-and-forth, First Deputy Speaker Bernard Ahiafor ruled that the L.I. should undergo a three-day review process by the Subsidiary Legislation Committee.
Now that the committee has completed its review, the instrument has been successfully laid before Parliament. Minister for Local Government, Ahmed Ibrahim, presented the L.I. on behalf of the Minister for Environment, Science, and Technology, Dr. Ibrahim Mohammed Murtala. He assured that the government had taken into account public concerns regarding mining in forest reserves and that the revocation of the President’s power would help improve the image of the House.
The New Patriotic Party (NPP) members of Parliament have expressed their support for the policy and have pledged to back the L.I., with Patrick Boamah, Chairman of the Subsidiary Legislation Committee, noting that there is no opposition to the rationale behind the instrument.
If passed, L.I. 2462 will become law 21 sitting days after its introduction, marking a significant step in Ghana’s ongoing efforts to combat illegal mining and its adverse environmental effects.
