Actualisation des textes sur la protection du patrimoine culturel : une nouvelle étape franchie

Au Togo, un nouveau tournant a été atteint dans la mise à jour des lois sur la protection et la promotion du patrimoine culturel. La commission en charge de l’élaboration de l’avant-projet de loi a finalisé un document de 97 articles, désormais soumis à validation depuis le 10 avril 2025.

Le texte révisé redéfinit les bases juridiques pour la sauvegarde des biens culturels, en précisant les processus de classification, de déclassement, ainsi que les mécanismes de préservation du patrimoine immatériel. Cette révision intervient après la loi de 1990, qui ne prenait pas en compte des évolutions récentes, comme la reconnaissance des patrimoines subaquatiques et des diverses expressions culturelles. L’initiative gouvernementale vise à répondre aux défis contemporains en matière de conservation.

L’avant-projet propose également un cadre pour le financement des actions de préservation et de promotion du patrimoine, en plus de définir les droits de préemption et d’expropriation. Des mesures conservatoires sont également prévues pour lutter contre l’exportation illicite des biens culturels.

Ce processus, soutenu par le ministère de la Communication, des Médias et de la Culture, bénéficie également de l’appui technique et financier de l’UNESCO. Dans le cadre du projet « Musée virtuel des objets culturels volés », l’UNESCO réaffirme son engagement pour renforcer les réseaux de lutte contre le trafic illicite de biens culturels en Afrique.
