
According to the Minority, the petitions submitted in support of the Chief Justice’s removal are without merit and do not satisfy the constitutional criteria required for such action.
Speaking at a press briefing on Wednesday, April 16, 2025, the Minority’s Legal Counsel and MP for Suame, John Darko, indicated that credible sources have confirmed the petitions lack substance. He emphasized the need for respected national figures to help preserve the integrity of the judiciary by discouraging any undue political interference.
The caucus described the current steps being taken as a “blatant usurpation of judicial authority by the President,” warning that the process threatens the independence of the judiciary and democratic governance
We are aware of plans for the invocation of article 146 (10) a to suspend the CJ and to appoint certain persons who are know sympathisers of the current administration to act as the Chief Justice. To the Judge or judges who may entertain the idea that Justice Torkonoo must be destroyed before you can rise, remember that you can rise together but if you destroy someone to rise posterity will not be kind to you,” John Darko said.
To our development partners and foreign missions in the country, this is the time our country needs you the most, the destruction of the Judiciary will begin the end of this country’s democratic experiment. Never in the history of this country, since Osagyefo Dr. Kwame Nkrumah in the Otchere case cited above, have we seen such naked attempt to subjugate the judiciary.”
He continued: “To our revered traditional leaders and religious leaders, the time to call the president to advise him is now, the time to pray for our country is now. We should not wait until it’s too late.”He cautioned against accepting frivolous petitions, emphasising that such actions could undermine Ghana’s efforts to strengthen its democratic institutions.
How can any serious country, mindful of its past, and desirous of improving its democratic credentials entertain such loose petitions and to orchestrate the destruction of the last bastion of the pillars our democracy,” he stated.He added: “To the people of Ghana, the call to the foreign partners, the call to our traditional leaders, the call to the civil society organisations in the country to rise up and speak against this usurpation of our judicial powers.”
“And most importantly to you, the people of Ghana, you are the fountain which justice flows from. So you are the one who can stop this naked usurpation of the judicial powers by the H.E John Dramani Mahama. You are the ones whose power is being taken away, you are the one whose sweat and toil keep this country running. You are the one who will suffer most when this democratic experiment collapses.”
