
Au Togo, l’Assemblée nationale a adopté, mardi 25 mars 2025, une nouvelle loi réformant le régime juridique des entreprises publiques.
Ce régime juridique constitue un ensemble de textes et règles qui encadrent la création, l’organisation, la gestion et le contrôle des entreprises détenues totalement ou partiellement par l’État. Le document ainsi adopté remplace la loi n° 90-26, en vigueur depuis 1989, et jugée obsolète face aux exigences du cadre juridique national, communautaire (OHADA) et international.
La révision s’appuie sur un benchmark des bonnes pratiques en Afrique francophone, avec pour objectif de doter le pays d’un dispositif cohérent, moderne et axé sur les résultats, selon l’Assemblée.
La réforme introduit notamment une meilleure clarification des missions, une gouvernance plus rigoureuse, une gestion orientée vers la performance et une plus grande transparence dans l’exploitation des ressources publiques.
Pour l’exécutif, représenté durant ces travaux parlementaires par Georges Essowè Barcola, ministre de l’Économie et des Finances, cette loi constitue un levier de rationalisation pour améliorer les performances publiques. « En [l’adoptant], vous permettez au gouvernement de disposer d’instruments essentiels pour la mise en œuvre de sa nouvelle vision concernant la gestion de ses structures publiques », a-t-il indiqué.
